Eighth Circuit declares RAZR the mechanism underneath sovereign law

There’s little doubt which today’s smartphones have been pocketable computers — they’re similarly or more powerful than a desktop PCs of yesteryear — though what about dumbphones? Well, in US v. Kramer, the Eighth Circuit Court of Appeals only hold that the Motorola Motorazr V3 fits a federal orthodox clarification for the mechanism — as well as quoted Woz in the opinion: “Everything has a computer in it nowadays.” Seems a bit silly to call a RAZR a computer, but courts can usually appreciate existing laws, not have new ones — and US law says a mechanism is “an electronic, magnetic, optical, electrochemical, or alternative tall speed data processing device behaving logical, arithmetic, or storage functions.” Because this was the first time a federal appeals court had ruled on the emanate, a Eighth Circuit set the fashion that other courts have been expected to follow. And yes, a court is aware such the definition may include microwaves as well as coffee makers, and informed Congress which it should shift a law if it doesn’t like it. Regardless of either you determine, this understand added some prison time for the man who pled guilty to perplexing to engage in passionate wakeup with the teenager, so a mild stupidity of it all is fine by us. Somewhere Chris Hansen is smiling.
